Abstract: |
The plaintiff purchased Automobile assembly and engine assembly from Hong Kong Yonglong Ltd. The goods passed through the custom agency of Lianyungang, Jiansu Province which decided that the goods satisfy the characteristics of being whole and levied the duties based on this. The plaintiff carried the goods to the city of Baoji, Shanxii province and asked the Imported Automobile Repairs and Supplies Factory to assemble the automobiles under the agreement. The defendant came to check and sealed up the plaintiff’s goods. The plaintiff objected and sued. During the suit, the defendant made the decision (“the decision at issue”)that the plaintiff’s goods had the characteristics of the whole automobiles while failing to go through the procedures of importing the whole automobiles. In addition, the plaintiff imported the used cars which violated the law. |
