Abstract: | China’s current foreign-capital legislation, a numerous sand jumbled system, fails to conform to the requirements of the principles of transparency under the WTO. Many stipulations conflict with the aim of WTO and shall be reenacted. China shall, based on the provisions of the WTO relevant to the investment, clear up and rebuild the law on foreign-capital so as to make a uniform company law, which applies to both the domestic enterprises and foreign-capital enterprises, and thus adapts to the requirements of China’s entry into the WTO. |
