Abstract: |
Transparency is one of the fundamental principles of WTO. It has inherent value for economic development of WTO members and the system of multilateral trade. The inherent value is predictability and calculability of law. Its purpose is to make the economic rational behavior above the legal rational behavior so as to prevent the uncertainties and reduce the transaction cost. WTO does not define the substantive criteria of transparency. It is through the design of procedures to implement this principle. Transforming a value problem into a procedural problem is a wise choice to break the political deadlock and couture discrepancy under the WTO. |
