Abstract: |
Wang signed a labor contract with the foreign company in December 1994. In June 1995, the company signed a supplementary agreement with Wang. According to the agreement, the company gave Wang 848,000 yuan to buy a house and Wang returned 1/240 of the money to the company every month. The company anticipated Wang to work for it no less than ten years and Wang agreed with all the terms. In July 2000, the company decided to rescind the contract. Wang could not accept it. The company sued, claiming that Wang should return all the lended money. Wang pleaded that it is a labor dispute, and the court could not hear it before arbitration. Wang applied for labor arbitration in November 2000. The Labor Dispute Arbitration Committee rejected his plea for the reason that the dispute related to a foreign company so it could not be applied for labor law. |
