Abstract: |
A third party company won the bid. The plaintiff applied to Bidding Office, claming that there was collusion in entering bids. It was replied that the evidence was inadequate to say there was collusion in entering bids. The plaintiff applied to the defendant for the administrative reconsideration, which made a decision of administrative reconsideration that the bidding of all three bidders concerned, including the plaintiff, was invalid. The plaintiff objected and sued on the basis that the defendant failed to comply with the legal procedures in making the decision. A hearing should have been held. |
