Abstract: |
It was a garden-variety spanking — on the bum, through clothing, emphatic but not vicious, a scene that plays out in stores and living rooms every day. It made me squirm, but I didn’t think the child was especially hurt. However, if a current challenge to the Criminal Code is successful, that mother’s actions could be considered assault. The case, heard last December in the Ontario Superior Court of Justice, was brought forward by an advocacy group called the Canadian Foundation for Children, Youth and the Law. If the application is successful, Section 43 of the Code would be struck down, making all forms of corporal punishment illegal. |
