Abstract: |
The issue about ignoring procedural justice has been the hot point in jurisprudence circle. Civil litigation, as an important way to make social justice a reality, needs not only procedural justice but also the guarantee of such justice. In China, the procedural justice is always ignored in the civil litigation. The sense of such justice among people is weak. It is thus necessary to inform China’s civil litigation system. The reforms should focus on the following, such as independence of courts and judges, establishment of adversary proceedings, grants for discretionary right of judges, principles of direct testimony and open justice. |
