Abstract: |
Cheng Gongcai and the other eleven persons were employees of Futong Auto Parts Company. They left the company and joined the Shanghai Dongyi Company (the third party) together. Their leaving greatly affected the employer’s business and management. The employer informed the third party that there were still employment relationship between itself and the twelve leaving persons. However the third party didn’t respond. The employer applied for arbitration then. Shiyan Labor Dispute Arbitration Committee decided that the twelve leaving employees should compensate the employer 270,000 yuan, and the third party should compensate Futong 1,090,000 yuan. The twelve employees sued. |
