Abstract: |
The plaintiff made a contract with a third party company which was a Chinese company. It was aimed at establishing an equity joint venture enterprise. The third party changes the contact unilaterally and applied to the defendant for approval. The defendant approved it and issued the Approval of Foreign Enterprises titled (1997) 0379. The third party later forged the supplementary contract stipulating that they were entitled to delay the investment. When they applied for the approval, the defendant approved by issuing the Approval of Foreign Enterprises titled (1997) 00383. The plaintiff requested the defendant to withdraw these two approvals and suffered refusal. The plaintiff sued. |
