Abstract: |
The third party, Baisheng Company, got loan from the plaintiff by way of mortgaging its building. The mortgage was registered at the defendant. However, before that, the said building had been mortgaged to somebody else and had been registered at the defendant too. Therefore, the defendant issued two certificates of land title to Baisheng Company on the same building which was actually was mortgaged twice. The plaintiff sued on the basis that it was because that the defendant was illegal to issue the certificate of land title that they made the contract with Baisheng Company and thus suffered losses. |
