Abstract: |
China’s current foreign-capital legislation, a numerous and jumbled system, fails to confrom to the requirements of transparency principle under the WTO. Many stipulations conflict with the aim of WTO and shall be reenacted. China shall, based on the provisions of the WTO relavant to the investment, clear up and rebuild the law on foreign-capital so as to make a uniform company law, which applies to both the domestic enterprises and foreign capital enterprises, and thus adapts to the requirements of China’s entry into the WTO. |
