Abstract: |
The defendant found that the package of the wine produced by the plaintiff had some words, which were very easy for consumers to take the plaintiff’s wine for other well-known wine. The defendant decided that the plaintiff’s behavior violated the Regulations of Sichuan Province on Anti-unfair Competition (article 12 (1)). Without being informed of the right to be heard and without holding the hearing, the defendant made the decision of administrative penalties (“decision at issue”). The plaintiff sued. |
