Abstract: | On 20 August 1999, the defendant issued a report, titled “On Hainan Kaili Company Listing on Stick Market” (being called “No. 39” Document) to the State Council of the PRC. It stated that 97% of profits of the plaintiff were false and decided to cancel its qualification of listing for it provided false application materials. On 28 April 2000, the defendant sent to the People’s government, Hainan province a circular about returning the plaintiff’s application materials of listing (being called “No. 50” Document) for the plaintiff provided false accounting materials. The copied document was sent to the plaintiff. The plaintiff sued against the defendant for they failed to find the out the correct facts, apply the correct law and follow the legal procedures. |
