Abstract: |
To gain a rational understanding of economic law, we should firstly comprehend the nature and form of the benefits behind norms of economic law, because any department of law is the result of benefit conflicts. Then we must deeply study the operating mode of the state power that regulates such benefit relations. This paper begins with the following two respects: first, specify the reasons why the economic laws grow by discussing the independence and features of economic laws; next, reflect on the nature of economic law from the perspective of operation of state power. , i.e., economic law is not only the law by which government intervenes the economy, but also the law by which the government is intervened. Meanwhile, according to the interpretation of the essence and form of law, the paper explains the phenomenon of “the integration of private law and public law” in the field of economic law. |
